As we reported in our blog last week, recently the Supreme Court granted same-sex couples the right to marry and divorce.
With this in mind, same-sex couples in Texas are already beginning the process of doing both. According to the Associated Press, a state district judge in San Antonio recently awarded shared child custody to a pair of same-sex parents. According to the news source, Bexar County Judge Renee Yanta awarded shared custody to Allison Flood Lesh and Kristi Lesh for their 2-year-old daughter.
The couple legally married in Washington D.C. in 2010 and Kristi was later artificially inseminated with their daughter, whom she gave birth to in February 2013. The couple then separated and Allison filed for divorce in February 2014.
Because of laws in Texas banning same-sex marriage, Allison had no parental rights over the girl, since she was not involved in her birth or conception biologically. It was only until the Supreme Court’s decision recently that her parental rights were recognized by the court, which granted her weekend visits with the child each month.
